He filed chapter 7 on 2/09/10. He has a car which has 11 more months on the loan before it's paid in full. The auto finance company (GMC) said they need a reaffirmation agreement or they will take his car. My father has left messages with his attorney regarding this. The attorney has not called back. According to her staff she is out of the country dealing with a family matter. The auto finance company has called my father almost daily asking for this document. She's been MIA for 2 1/2 weeks now. My father paid her a hefty fee, so he can't switch attorneys at this point.
The auto finance company said they are willing to complete the form as long as he approves of it. I told my father he should wait for his attorney before he signs anything. I never filed bankruptcy before, so I don't know what to tell him. We call another attorney in town, and he said the reaffirmation agreement has to be completed by his attorney first. Then the paperwork is submitted to the auto finance company...this is true? -
