The Chicago Cubs are hoping to shut down two men who they say are exploiting their team and their fans.
On Friday, the team took legal action against John Paul Weier and Patrick Weier who are accused of showing up at games in a fake costume, misleading fans who were hoping to meet the team's real mascot Clark the Cub.
The imposter mascot, Billy Cub asks fans for tips in exchange for photos. There have even been cases where
Billy Cub has used racial slurs and other derogatory remarks towards fans, the lawsuit claims. Billy Cub was also caught on cellphone video in a bar punching a man for taking off his bear head. The video went viral, with several media outlets incorrectly reporting the official Cubs mascot was involved.
According to an NBC Chicago report, John Paul Weier is also being accused of running a website that sells merchandise related to the character.
The Cubs are asking the court to order the Weiers to stop using the Billy Cub character and "deliver for destruction" all merchandise, advertisements, packaging, costumes or other materials related to the character, local media reports.
