Megjithëse ka paraqitur prova te reja shtese, te cilat vërtetojnë se ish-Komandanti i Gardës, Ndrea Prendi është personi qe ka qëlluar ne 21 janar mbi protestuesit e opozitës, duke lënë te vrare njërin Faik Myrtajn, Gjykata e Apelit nuk ka pranuar te ndryshoje masën e sigurisë për te, nga arrest shtëpie ne arrest me burg, duke shënuar kështu një rast te paprecedent për një te dyshuar për vrasje. Ndërsa qe ne fillim te seancës, e cila u zhvillua me dyer te mbyllura, avokati i Prendit, Genc Gjokutaj, kërkoi dorëheqjen e anëtares Zegjine Sollaku, bashkëshorte e ish-kryeprokurorit Theodhori Sollaku. Shkaku i kësaj kërkesë, sipas avokatit, ishte fakti se Sollaku kishte patur një konflikt personal me Prendin ne vitin 2006 për shkak te ndërrimit te eskortës se ish-kryeprokurorit. Kjo kërkesë u shqyrtua nga gjyqtari Artur Kalaja, i cili vendosi ta pranoje atë. Sollaku u zëvendësua nga gjyqtari tjetër, Agron Papajani. Pas 30 minutash shqyrtim gjyqësor, treshja e gjyqtareve vendosi ti thotë serish jo kërkesës se akuzës për Prendin. Tashme mbetet qe Prokuroria ti drejtohet me rekurs Gjykatës se Larte dhe nëse edhe kjo gjykate nuk pranon kërkesën e akuzës, Prendi do te jete ne arrest shtëpie deri ne përfundim te gjykimit.
