LITTLETON, COLORADO — A Colorado homeowner who fatally shot a man suspected of robbing him at gunpoint on Sunday could face criminal charges.
The unidentified man shot and killed suspect David Martinez, 38, as he tried to steal his car from his driveway, according to Fox 31 Denver.
The homeowner told investigators that Martinez and an unidentified Hispanic man in his 40s arrived at his home on Sunday morning to inspect items he had advertised for sale on Craigslist, Fox 31 Denver reported.
After looking at the items for a while, the suspects pulled out a gun and tied the homeowner up. Then they stole things from his house and tried to make their escape.
The homeowner managed to free himself, grab his gun and run outside as the suspects fled.
He fired several shots at his own car as Martinez sat inside, trying to steal the vehicle. Martinez crashed the SUV into a neighbor's home about a block away. He was taken to the hospital, where he later died of his injuries.
Martinez had a lengthy criminal history of burglary, theft and drug-related offences, Fox 31 Denver reported. The other suspect, who escaped in a gold Mustang that the two men arrived in, remains at large, according to Denver's CBS 4.
Under Colorado's "Make My Day" law, a homeowner can shoot without warning an intruder who enters his home. But according to ABC affiliate Denver 7 legal analyst David Beller, the law only applies to inside the four walls of the house and "does not include the porch, the yard, the driveway, [or] the street outside."
